This is a section taken from the article you’ve posted a link to and I agree:
“But the county argued that the pictures were pornographic because they were disseminated for the purposes of sexual stimulation and so would be of great interest to child molesters.”
I would agree with the first answer posted but you have to keep in mind that this wasn’t a girl exposing her breasts in the street (i.e. “indecent exposure”) – this is a permanent picture that will forever be in cyberspace and easily found by pedofiles, and viewing of this picture(s) encourages the sexual temptation of a pedofile – this is what they look for on the internet, then come looking for children to act it out on – it’s extremely disgusting and I also want to say “shameful” on the girl who posed and posted the picture (and shame on the mother for taking this lightly – where’s her backbone as a parent? This is not ok and should not be taken so lightly.)
But then you have to take into consideration: teenage sex.
Can 2 consensual teenagers be charged of “child molestation”? What then of the teenage parents – how would that be handled?
This subject just has to many things that can be intertwined and makes it a bit difficult to thoroughly discuss and address properly.
However, to make it simple, child pornography IS illegal and because the picture depicts a minor in a sexual manner (“for the purposes of sexual stimulation”) then the photograph is indeed illegal and those parties responsible should be held accountable.
While this would be something that could follow her for the rest of life (on her record, etc.) then she needs to take this as a lesson learned. This is exactly why teens need to think about everything & anything they do BEFORE they do it – they need to take responsibility for thier actions, whether or not the consequences are long term. Let this be a lesson to all the teenagers out there – hopefully this will put a stop to teenagers posting this kind of disgusting thing in the future, among other ridiculous behavior.
In short: yes, she should be prosecuted.
